2010 WTO Special Agricultural Safeguard Trigger Levels

Pursuant to Agricultural and Agri-Food Canada's July 17, 2008, Canada Gazette Notice of public consultations on proposed price and volume triggers required to operationalize, for supply-managed products, the special agricultural safeguard (SSG) established under Article 5 of the World Trade Organization (WTO) Agreement on Agriculture, notice is hereby given of the SSG price and volume triggers for the 2010 calendar year.

In Canada, Article 5 of the WTO Agreement on Agriculture was implemented through Section 68 of the Customs Tariff and through the Safeguard Surtax Regulations 1995-(1,2,3). These regulations prescribe the goods that may be subject to a SSG surtax and notably include all supply managed goods. Canada reserved the right to use the SSG in respect of all of its over-access tariff items, including supply-managed products.

Section 68 of the Customs Tariff specifies that the Minister of Finance may, on the basis of a report from the Minister of Agriculture and Agri-Food specifying that the conditions set out in Article 5 of the WTO Agreement on Agriculture have been met, recommend, by Order, that any prescribed agricultural goods specified in the Order be subject to a surtax, at a rate specified in the Order. The Minister of Agriculture and Agri-Food intends to submit such a report only in cases where there has been a significant and sustained surge in over-quota imports.
